Do I qualify for the K-1 Fiance Visa?
You are eligible for a K-1 fiance if your intended spouse is a U.S. citizen (not a green card holder or a permanent resident. Both you and your spouse must be legally able to marry and the intending immigrant must have a genuine desire to marry the petition after arriving in the United States. You must also have met each other in person within the past two years.
K-1 Visa Process
- File the visa petition on form I-129 to USCIS.
- After petition approval, submit the visa application online.
- Prepare the documentation and bring to the interview.
- Enter the U.S. with the K-1 visa.
Proof Required for the Petition
- Proof of Petitioner's U.S. Citizenship - Passport, birth certificate, naturalization certificate
- Proof of ability to marry - Birth certificate to show legal age, proof that prior marriages have been legally terminated
- Proof of intent to marry - wedding preparations, letters or affidavits for interested parties
- Proof of your relationship
- Certified copies of any court records
- U.S. passport style photos of the petitioner and spouse
